This will require them to conduct a risk assessment to identify and classify personal data, as well as updating their compliance frameworks. For example, organisations will need to review their data retention and breach notification policies to ensure they are aligned with the PDPO’s requirements.

In addition, the PDPO requires data users to obtain the voluntary and express consent of the data subject before transferring personal data to a third party for processing. This requirement can be challenging for some companies, particularly in the context of international transfers.

The recent agreement between the Mainland and Hong Kong to establish rules for transferring data across the Greater Bay Area (GBA) will create a wealth of demand for city-based data centres.
