However, this isn’t always practical. In such cases, the data controller must have a lawful basis for transferring the data. This could be the case if the data is necessary for the performance of a contract or if it is in the public interest.
If the data is not necessary for the performance of a contract, it must be subject to ‘limited purposes’ which must be set out in the data controller’s privacy policy. The policies should also explain how the information will be used and why it is being transferred.
The limited purposes should not be discriminatory, disproportionate or excessive and must be proportionate to the purpose for which the information is being collected. This should be accompanied by a clear statement that the data will only be used for this purpose and no other.
